These Terms & Conditions (“Terms”) govern your access to and use of the MyPlays service (“Service”) developed and provided by Inovex Technology (“Company”, “we”, “us”, or “our”). By using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Client/User: Any individual or entity that accesses or uses the MyPlays Service.
Service: The MyPlays arcade management software platform, including all features and modules.
Arcade Machines: Game machines managed or tracked by the Service.
The Service is designed exclusively for the management, tracking, and optimization of arcade machine operations for legal, skill-based entertainment businesses.
MyPlays does not process, handle, or facilitate any form of monetary transactions through its platform. All financial transactions related to arcade businesses must occur through systems outside of MyPlay.
The Service is intended to be used only in regions and jurisdictions where skill-based arcade game operations are legal and compliant with local laws.
User Responsibility: You (the user) are solely responsible for ensuring that your use of MyPlays and your arcade operations comply with all applicable local, state/provincial, and national laws and regulations concerning arcade entertainment, skill-based gaming, gambling, currency handling, data usage, and any other relevant subject matter.
You must verify that all arcade games managed or tracked through MyPlays are genuinely skill-based and do not involve games of chance, gambling, or other prohibited activities under your jurisdiction's laws.
You understand, acknowledge, and accept that Inovex Technology provides MyPlays strictly as a management and tracking tool, not as a platform for conducting or facilitating any form of gambling or financial transaction.
You may not use MyPlays for any purpose that is unlawful, unauthorized, or violates these Terms. Prohibited activity includes, but is not limited to:
Inovex Technology may, at its sole discretion, suspend or terminate access to the Service if illegal or unauthorized use is suspected.
The Service is provided strictly as a tool for legitimate, skill-based arcade management in compliance with local laws.
User liability: You are fully and exclusively liable for any illegal or prohibited use of the Service, including all regulatory compliance, licensing, and legal obligations associated with your arcade business operations.
Inovex Technology expressly assumes no liability for any illegal, unauthorized, or non-compliant activities conducted through the Service.
Where required, Inovex Technology may report suspected unlawful activity to appropriate authorities and cooperate fully with any legitimate investigation.
Intellectual property associated with the Service and any pre-existing tools, methodologies, or technology remains the exclusive property of Inovex Technology.
Users are granted a non-exclusive license to use the Service as intended for legitimate business operations in accordance with these Terms.
You are responsible for maintaining the accuracy and security of all information and data provided to or managed through the Service.
Inovex Technology implements reasonable security measures but cannot guarantee absolute security of electronically stored data.
The Service is provided "as is" and "as available," without warranty of any kind, express or implied.
Inovex Technology disclaims any liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business opportunity, or data, arising from or related to the use or misuse of the Service.
The maximum liability of Inovex Technology to any user shall not exceed the total amount paid by the user for use of the Service in the six months prior to the event giving rise to the claim.
Inovex Technology reserves the right to modify these Terms at any time. Notice of material changes will be provided via the website or direct communication.
Continued use of the Service constitutes acceptance of updated Terms.
Either party may terminate use of the Service in accordance with these Terms and any Service Agreement in effect.
These Terms are governed by the laws of the jurisdiction specified in your Service Agreement or, if unspecified, the jurisdiction of Inovex Technology's primary office.
Disputes will be resolved through good faith negotiations and, if necessary, binding arbitration in accordance with relevant rules, as set out in the general company Terms of Service.
